By the early 2000s, EPA had a problem that looked deceptively simple: the Interim Enhanced Surface Water Treatment Rule had meaningfully strengthened Cryptosporidium protection at large systems, but it only applied to systems serving 10,000 or more people — leaving thousands of smaller surface water systems on the older, looser 1989 standard. At the same time, evidence was accumulating that a uniform national Cryptosporidium requirement was both overprotective at some plants and underprotective at others, because actual Cryptosporidium risk varies enormously by watershed.
